Acceptance of the Terms is a condition of registration and of online booking.

  • Booking: a booking request submitted by the Pet Owner to a given Salon for a given time and service.
  • Grooming service: the service performed by the Salon on the pet (e.g. bathing, clipping, nail trimming).

1.4 Legal background

With regard to these Terms and the use of the Platform, the following laws apply:

  • Act V of 2013 on the Hungarian Civil Code (Ptk.);
  • Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses;
  • Act CLV of 1997 on Consumer Protection;
  • Act CVIII of 2001 on Certain Issues of Electronic Commerce Services (Ektv.);
  • Regulation 2016/679 of the European Parliament and of the Council (GDPR);
  • Act CXII of 2011 on the Right of Informational Self-Determination (Infotv.).

2. Nature of the Platform, contractual relationships

2.1 The Operator's intermediary role

The Operator provides an online intermediary platform whose purpose is to facilitate contact and appointment booking between the Pet Owner and the Salon. The Operator does not provide pet grooming services and is not a party to the service contract between the Pet Owner and the Salon.

2.2 The contract for the grooming service

The contract for the use of the grooming service is concluded directly between the Pet Owner and the Salon concerned, upon confirmation of the Booking by the Salon. The Salon is solely responsible for the performance and quality of the service, for pricing and for the information relating to the service.

2.3 Legal relationship with the Operator

The subject of the legal relationship between the Operator and the Pet Owner is solely the provision of the use of the Platform (account, management of pet data, browsing of grooming salons, forwarding of booking requests to the Salon). The use of the Platform is free of charge for the Pet Owner.

3. Registration and account

3.1 Methods of registration

The Pet Owner may register by providing an email address and a password, or by signing in with an external account (Google, Facebook) (social login). In the latter case, the basic data received from the provider (name, email address) are used to create the account; the missing data required for booking (e.g. phone number) must be provided separately by the Pet Owner.

3.2 Rules concerning the account

  • The Pet Owner is obliged to provide true, accurate and up-to-date data.
  • A Pet Owner may create one account; the account is personal and may not be transferred to a third party.
  • The Pet Owner is responsible for keeping the login credentials of their account secure and for all activity carried out through their account.
  • To use the Platform, the Pet Owner must have reached the age of 16. A person under the age of 16 may use the Platform only with the consent of their legal representative.

4. The booking process

4.1 Submitting a Booking

On the Platform, the Pet Owner selects the Salon, the pet, the service(s) and the desired time, and then submits the Booking. Depending on its booking settings, the Salon may confirm the Booking automatically or may make it subject to manual approval.

4.2 Booking access modes

The Salon is entitled to determine who may book with it online (e.g. anyone as a guest, only registered Pet Owners, or only existing clients). The Operator is not responsible for these conditions set by the Salon.

4.3 Confirmation of the Booking

The service contract is concluded upon confirmation of the Booking by the Salon. Until confirmation, the Booking is to be treated merely as a request, which the Salon may reject.

5. Cancellation, modification, no-show

5.1 The Salon's cancellation rules

The modification and cancellation of a Booking are governed by the cancellation policy of the Salon concerned (e.g. cancellation deadline). The Pet Owner can find information about these during the booking process and in the confirmation.

5.2 Consumer right of withdrawal

The grooming service qualifies as a service related to leisure activities, provided for a specific date, in respect of which, pursuant to point l) of Section 29(1) of Government Decree 45/2014 (II. 26.), the consumer is not entitled to the 14-day right of withdrawal. The cancellation of a Booking is therefore governed by the Salon's cancellation rules. This does not affect the deletion of the Pet Owner's platform account at any time, free of charge (see point 10).

5.3 Failure to attend (no-show)

If the Pet Owner does not attend a confirmed Booking and has not canceled it in advance, the Salon is entitled to record this and to restrict the Pet Owner's future online booking access (see point 8). Repeated no-shows may also affect the legal relationship between the Salon and the Pet Owner.

6. Fees

6.1 The Platform is free of charge

The use of the pet owner portal, registration and online booking are free of charge for the Pet Owner.

6.2 Fee for the grooming service

The fee for the grooming service is set by the Salon, and the Pet Owner pays it directly to the Salon, in accordance with the contract concluded with the Salon. If a Salon makes online payment of a deposit or of the fee available, separate information on its terms is provided during the payment process.

7. Obligations of the Pet Owner

7.1 True data and safety

The Pet Owner is obliged to provide the data of their pet (in particular its state of health and any aggressive tendencies) truthfully. This is essential for the safety of the Pet Owner, the pet and the Salon's staff members.

7.2 Lawful use

The Pet Owner may use the Platform only for its intended purpose and lawfully. It is prohibited to interfere with the operation of the Platform, to gain unauthorized access to the data of other Pet Owners or Salons, and to share data learned on the Platform with third parties.

7.3 Attending the appointment

The Pet Owner undertakes to attend the confirmed Booking or to cancel it in good time in accordance with the Salon's rules.

8. Restriction of access, ban

8.1 Exclusion by the Salon

The Salon is entitled to exclude the Pet Owner from online booking with it (ban), in particular in the event of repeated no-shows, aggressive behavior, an aggressive pet or unsettled payment obligations. In such a case, the Pet Owner cannot book online with the Salon concerned, but may still contact the Salon directly. The ban applies to the Salon concerned and does not affect the Pet Owner's access at other Salons.

8.2 Measures taken by the Operator

The Operator is entitled to suspend or terminate the Pet Owner's account if the Pet Owner seriously or repeatedly breaches these Terms, or violates the law.

9. Liability of the Operator

9.1 Responsibility for the quality of the service

Since the grooming service is provided by the Salon, the Salon is solely responsible for its performance and quality and for any damage related to it. The Operator is not a party to any dispute between the Pet Owner and the Salon.

9.2 Availability of the Platform

The Operator strives for continuous, uninterrupted operation of the Platform, but provides it "as is" and does not guarantee uninterrupted availability. The Operator is entitled to carry out maintenance, of which it gives advance notice where possible.

9.3 Limitation of liability

The Operator is not liable for damage resulting from the inaccuracy of the data provided by the Pet Owner, from the Salon's booking settings, or from the legal relationship between the Salon and the Pet Owner. The Operator's liability is limited to the fullest extent permitted by applicable law; this does not affect liability for damage caused intentionally or through gross negligence, or for damage caused to human life, physical integrity or health.

10. Deletion of the account, termination of the legal relationship

The Pet Owner may request the deletion of their platform account at any time, without giving reasons and free of charge, at info@petmetic.hu or through the dedicated function of the Platform. Deletion of the account does not affect obligations toward the Salon arising from Bookings already confirmed. The rules on data retention are set out in the Pet Owner Privacy Notice.

11. Intellectual property

The Platform, its visual identity, software and content are the intellectual property of the Operator (or its licensors). The Pet Owner receives a limited, non-exclusive, non-transferable right to use the Platform, solely for the purpose set out in these Terms.

12. Data protection

The processing of the Pet Owner's personal data is governed by the separate Pet Owner Privacy Notice, which describes, among other things, the division of data controller roles between the Operator and the Salons.

13. Complaints handling, consumer protection

13.1 Complaints to the Operator

The Pet Owner may submit complaints relating to the operation of the Platform to info@petmetic.hu. The Operator examines the complaint and responds to it on the merits within the statutory deadline.

15. Miscellaneous provisions

15.1 Amendment of the Terms

The Operator is entitled to amend these Terms. The Operator informs the Pet Owner in advance of material amendments on the Platform or by email. The text of the Terms in force from time to time is available at https://petmetic.hu/gazdi/aszf.
